The distribution statement on both is the same though. Both of them say for official use only.
Even the ones you get off the navy public website say āReproduction for nonmilitary use of the information or illustrations contained in this publication is not
permitted without specific approval of the issuing service (CNO)ā
I understand the violations of export laws, but I feel like disseminating FOUO docs for the purpose of a game is a grey area at least.

Which 2 manuals are you looking at exactly because the NATOPS ones seem a bit more lapse - although the information in them is also less detailed.

the f18 natops does not have that export statement on it, which is what he is being charged for violating.
So while you wont find yourself in violation of export laws for the NATOPS, it still says FOUO on it, which gaming is clearly not official use.
Hypothetical Below:
What Iām getting at here is that IF using the NATOPS and other similar publications without official permission would still technically be considered illegal, could the US govt not go after ED and any other 3rd party developer using these documents without express permission?
I think on the developers end there is at least a healthy fear of the MOD following through on document security. But it seems to be a much more cavalier attitude toward western publications.

It doesnt, I asked what the difference between the NATOPS manuals and the ones he is being charged for having is. Which it appears to be that export control statement.
According to that Air Force TOs are considered defence articles designated CAT 1 on the ITAR US Munitions List and cannot be exported without a license or authorisation from the state department.
If NATOPS come under the same thing then it needs investigation.
If that really is the reason (and I do not believe that it is) then ED would not be a company Iād care to continue to support. They make a game that I have enjoyed for nearly half my long life if we go back to Flanker 1.0. But if they were really that cavalier then I would happily drop DCS and move on.

Because sharing this info is so easy it has got to the point where no one considers the impact and I doubt most would ever care to even look at the legal side.

Dear all,
I have noticed still many violations to this rule. I cannot stress enough how important this rule is in a multinational forum, with a multinational company developing fairly modern simulations of weapon systems. Sharing information from the internet may seem harmless, but there are many things out there that really shouldnāt be, and with ED dealing with companies that expect ED to be professional and respect those boundaries, sharing this info can end badly not just for us, but for users sharing this info.
The Hornet and other modules are developed to be the most accurate simulations you can find, its been this way since the A-10C and Ka-50, but even then, there are limitations out there that require us not to model certain aspects, or change how they are modeled to protect sensitive material. We may model a system differently than how it is, just to get it to feel like the real thing, but not offer up any secret info on how it actually is, or in some cases, we may not be able to model it at all.
We need to all be better at what we share here, and as such, since this rule has been in place for a while, warnings will be issues on a more regular basis with this violation. I hope you all understand why we need to do this, and try and help make sure this rule is followed.
UPDATE
1.16 violations will first be 20% perma warning, 1 week off. A second violation will be another 20% perma and one month off. A third violation will be 100% warning and 1 year off. After the 1 year, your 100% warning will remain intact, and any further violations will result in a permanent ban on these forums.

I honestly doubt that ED had any ulterior motives. Theyāve been teasing the F-16 since last fall, through the middle of winter, and on; itās getting close to the start of summer, so it seems more like itās just drumming up PR and interest.
When it comes to the US govāt, classification of material is done in a hamfisted, lame, absolutely as dumb as you can get manner. The FOUO thing is a cop-out by lazy bureaucrats who donāt want to properly classify the material. That might take work and they canāt have that, might sprain their finger doing the extra step.

There are certain facts that are known in this matter.
We know why Tishenko has been arrested.
He was employed by ED.
We have EDās statement.
The rest is conjecture and speculation.
Why ED chose to post some screenshots just now, is anybodys guess.
They must have known about Tishenkos predicament for a while now. Longer than us, anyway. They have also been developing the F-16 module for some time.
None of us has any inside info that says otherwise.
Letās not hang anyone from the nearest tree, over this.
